Terms of Service

domainhealthpro.com (the "Service") is operated by Ideal I.T. ("Ideal I.T.", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

The Service

DomainHealthPro checks and monitors publicly available domain configuration — including SPF, DKIM, DMARC, mail servers, domain registration, and SSL certificates — and notifies you of issues. You may only monitor domains you own or are authorized to manage.

Accounts

You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information and keep it up to date.

Subscriptions & billing

Paid plans are billed in advance on a recurring basis through Stripe. Plans may include a trial. You can cancel at any time via the billing portal; cancellation stops future charges and takes effect at the end of the current period. Fees are non-refundable except where required by law.

Acceptable use

Do not use the Service to check domains you are not authorized to assess, to break any law, or to disrupt the Service. We may suspend accounts that violate these Terms.

No warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Checks rely on public data and third-party sources and may be incomplete, delayed, or unavailable. We do not warrant that the Service will be uninterrupted or error-free, that it will detect every issue, or that it will prevent any outage, expiry, blacklisting, deliverability problem, or security incident. You remain solely responsible for your own domains and infrastructure.

Limitation of liability

To the maximum extent permitted by law, in no event will Ideal I.T. be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Service, whether based in contract, tort, statute, or otherwise, even if advised of the possibility of such damages. Our total aggregate liability for any and all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the three months before the event giving rise to the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Ideal I.T. and its owners, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content or domains, your violation of these Terms, or your assessment or monitoring of any domain you were not authorized to assess or monitor.

Binding arbitration & class-action waiver

Please read this section carefully — it affects your legal rights. Except for claims that qualify for small-claims court and requests for injunctive relief, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration, administered by a recognized arbitration provider (such as the American Arbitration Association) under its consumer arbitration rules, rather than in court.

Class-action and jury-trial waiver: you and Ideal I.T. agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You and Ideal I.T. each waive any right to a jury trial. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and heard in court.

30-day opt-out: you may opt out of this arbitration agreement by emailing support@domainhealthpro.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.

Governing law

These Terms and any dispute relating to the Service are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to the arbitration section above, the state and federal courts located in Florida will have exclusive jurisdiction, and you consent to personal jurisdiction and venue there.

Electronic communications & consent

By creating an account or using the Service, you consent to receive communications from us electronically (including service, security, and billing notices) and agree that electronic agreements and notices satisfy any legal requirement that such communications be in writing. You also consent to our processing of data as described in our Privacy Policy, including our use of privacy-first, cookieless analytics and bot protection.

Changes

We may update these Terms; material changes will be posted here. Continued use after changes means you accept them.
